Legal Regulation Of Public Welfare Crowdfunding In China From The Perspective Of The Charity Law

Public interest is the emerging public welfare crowdfunding model this year.In recent years,some achievements have been achieved,and there are some cases of dishonesty that restrict its further development.Through the analysis of literature,analysis of cases,comparative summary and other methods,discusses the existing problems of public welfare and the shortcomings in the legislation,and puts forward some suggestions to improve the public welfare crowdfunding.This article clarifies the concept of public financing,distinguishes the public financing from the other public financing models and network fundraising models,analyzes the legal relations of the public to participate in all parties,briefly introduces the current situation of the development of public interest and the status of legislation in our country,and leads to the problems in public research and development in our country.The main problems include asymmetric information,inadequate supervision and unclear responsibilities.It is mainly from the perspective of "charity law" to improve the legal regulation of public welfare in our country.First,we should establish the system of public interest and make clear the public to raise the CITIC.The scope of information disclosure,strengthen the credit system construction,making information more scientific and reasonable;secondly,to improve the supervision and management mechanism,the quality of public platform should be carefully checked,the use of good funds and follow-up treatment in place,reasonable disposal;finally,clearly the rights and responsibilities of the parties to the platform.To clarify the obligation to review,to emphasize the obligation of integrity and to violate the obligations of the law or breach of duty,for the contributor,it should be given to the donor under certain conditions of the right to revocation,and set up a calm period system.
