Research On Legal Regulation Of Network Public Welfare Crowdfunding

The Network Public Welfare crowdfunding is the time product which the traditional public welfare donation and the Network Technology Organic Union,is playing the vital role by its unique superiority in the public welfare donation domain,this mode of public welfare donation has some problems in legal supervision while it has become a popular way to seek help.This paper is divided into five parts:The first part,Introduction.This part mainly explains the research background,domestic and foreign research situation,research ideas and main contents,research methods and possible innovation,which paves the way for the following research.The second part,mainly discusses the network Public Welfare crowdfunding related to the basic theory.From the social point of view,the network public welfare crowdfunding is a kind of fund-raising method,which needs three complete elements:sponsor,investor and platform to cooperate.From the legislative point of view,the network public welfare crowdfunding is a kind of non-profit financing behavior,which refers to the collection of funds through the platform and the development of charitable activities.The development of Network Public Welfare crowdfunding is closely related to the maturity of technology,the breakthrough of traditional charity restriction,the Promotion of Network Economy and the support of government.Taking the network public welfare crowdfunding platform as the core,it forms four legal relations: sponsor,investor,beneficiary and crowdfunding platform,which is the foundation of analyzing the network public welfare crowdfunding operation.The third part,the main discussion network public welfare crowdfunding practice in the operation of the problem.This paper points out that the current legislation of the Network Public Welfare crowdfunding in China is not clear enough,this is mainly reflected in the network public welfare crowdfunding platform outside the existing legislation,the sponsor's legal status and obligations of uncertainty,the platform and the sponsor's lack of legal responsibility mechanism.Of course,there are still some problems,such as imperfect operation mechanism and lack of supervision mechanism,incomplete examination and disclosure of information,lack oftransparency in the management and use of funds,lack of protection of personal privacy,impact of credit crisis,etc.The fourth part,mainly discusses the practice of legal regulation of Public Welfare crowdfunding outside the network.This paper points out that,from the perspective of the legal regulation practice in the United States,the United Kingdom and Germany,China should establish a unified platform for access to public interest crowdfunding standards,information disclosure system.The fifth part,this part mainly proposed the Regulation Network Public Welfare crowdfunding proposal.This paper proposes that,firstly,the relevant legal mechanism of Network Public Welfare crowdfunding should be established,and on the basis of establishing the principles to be followed in legislation,the level of legislation related to network public welfare crowdfunding should be raised,second,to improve the supervision mechanism of Network Public Welfare crowdfunding,we should focus on strengthening government supervision,improving social supervision,and strengthening self-discipline.Third,we will establish a public information disclosure mechanism and a social credit system,with the focus on strengthening the construction of the information disclosure mechanism and the social credit system.Fourth,we will establish a personal information security protection mechanism for public fundraising on the Internet,fifth,we should establish the third-party fund-keeping mechanism to solve the problem of fund management transparency,and finally,we should establish the access and exit system of all parties involved in the network public fund-raising.
