Zheng Dexing used a large number of loans and then he had to commit suicide because he was unable to repay the loan.In 2016,the naked loan was all known.And in 2017,more than 150 college students were involved,and 12 provinces and cities such as the three provinces of the Northeast,Shandong,Guangdong,Chongqing and other provinces and cities were reacted with the aid of the "campus loan" platform.The loan fraud on campus is serious.Because of these,the office of the Ministry of education and the office of the China Banking Regulatory Commission have jointly issued the notice on strengthening the risk prevention and education guidance of the unhealthy network lending on campus,which is intended to strengthen the supervision and regulation of bad loans on campus.However,it is undeniable that China's current Internet financial management system and related laws and regulations still have many shortcomings.Thus,it is of great theoretical and practical value to study the penal law regulation of fraud in campus loan.Based on the current situation of the current network loan on campus in China,this paper analyzes the characteristics of the network loan fraud on campus and the reasons for the high incidence of the network loan on campus on the basis of the development of the network loan on campus.Then,the paper analyzes the necessity and feasibility of the penal regulation of fraud in the campus net loan,as well as the identification of its crimes and the application of the penalty,and discusses how to further improve the penal regulation of the network loan fraud on campus and effectively curb the occurrence of fraud.Specifically,qualitative analysis is used to analyze and demonstrate the criminal nature of network loan fraud on campus from the four elements of crime constitution.Through the study of fraudulent practices,especially Internet fraud and financial fraud,we can understand the fraud behavior of campus network in a comprehensive and scientific way.Through the past two years,campus network loan typical fraud cases for more intuitive empirical analysis and demonstration.Through the comparative study of the penal system at home and abroad,combined with our judicial practice,we explore how to improve the penal regulation of network loan fraud on campus.Finally,it provides some enlightenment for the application of penal law,the moderate adjustment of the penalty and the revision of the penal law in the campus network of our country,perfecting the penal law regulation of the fraud in the campus net loan,effectively restraining the fraud,protecting the interests of the college students and promoting the development of the network loan on campus.
