The Local Construction Of The Right To Be Forgotton In China

The right to be forgotten,as a newly emerging independent civil right,which is different from the right of privacy and personal information,should be brought into the civil-law system and fully protected.In 2014,the right to be forgotten was firstly established by European Union in a verdict.Besids,America,Russia and other countries also have some concerned rules about it.There are similar regulations about the right to be forgotten in more than two hundred legislations and legal practices in China.The first case of the right to be forgotten arose in juridical practice in 2015.Therefore,the status of Chinese right to be forgotten has been equipped with the bases of theory,society,legislation and practice.The concept,property,and application of law on this right should be clarified on the basis of available legislation and juridical practice.Our country should learn from other countries to improve continuely the pattern of legislation and enact "Act on the Protection of Personal Information",so that we can reinforce public administration and take effective measures of judicial remedy.Efforts to protect the right to be forgotten should be strengthend in order to promote the protection of personal information.Consequently,legitimate interests of citizen and security interests of our country can be protected.
