In response to the increasingly serious problem of parking disputes in the community,Article 74 of Property Law of China has made corresponding provisions,which fills the gaps in legislation in this area before.To a certain extent,it has eased the ownership of the parking space dispute in community.However,Property Law only preliminarily defines the ownership of the parking spaces.It generally covers that parking spaces should meet the needs of the owners first,and owners can stipulate the belonging of parking spaces in the scope of the building planning.It also has brief stipulation on the ownership of parking spaces occupying other sites which belong to the common owners.The current contradiction about parking spaces has been extended from the dispute between the owner and the developer to the owner and the property management company.To solve this complex conflict,it is very useful to definite the ownership of the parking space in the community clearly.The parking spaces are divided into legal parking space and agreed parking space.Combined with the actual situation,Article 74 of the Property Law will interpret the loopholes in detail and regulates the provisions for registration.A diversified approach is adopted to resolve property management disputes in the community caused by the unclear ownership of parking spaces.
