Research On The Retention Measures Of The National Supervisory Commission

The Communist Party of China(CPC)has made the decision to deepen the reform of the national supervision system.From the new Amendment to the Constitution,Section vii,the supervisory organs are regulated and the supervisory commission is to be set up.According to The Amendments to the Constitution,the National People's Congress(NPC)formulated the supervision law of the People's Republic of China(the supervision law).From the amendment,the retention measure,as the only way of restricting personal freedom,is getting more and more attention.As a powerful measure to restrict personal freedom,implementing the lien can cause abuse of the lien,which can easily fall into the quagmire of power alienation.To restrict abuse of lien and ensure the detained person's legal rights,the connotation of the lien measure and attributes of right should be made clear,and the process of implementing the lien measure should be regulated,which will be applicable to the judicial problem and tort relief mechanism.Importance should be attached to the rule of law,which can help form a complete and serious regulating system.In this way can the lien measure be restricted from the perspective of the entity and procedural rules and be implemented in a correct way.
