On The Dual Attributes Of The Supervisory Committee

The establishment of the State Supervision Committee is a major change in China’s political system,reshaping the organizational form of China’s political power,bringing all the people who exercise public power into the scope of unified supervision,and realizing the organic unity of inner-party supervision and state supervision,governing the party according to rules and governing the country according to law.Under the system of joint office,supervision power is not a single state power,especially when the state supervision power includes the power of discipline inspection,the attribute of discipline inspection power has a great impact on the attribute of supervision power.As for the nature of the supervisory committee,the interpretation of the super visory law of the People’s Republic of China clearly states that the supervisory committee is a special organ exercising the state supervisory function.By working together with the party’s discipline inspection organs,the supervisory committee realizes t he party’s leadership over the state supervisory work.It is a political organ strengthening the self supervision of the party and the state,not an administrative organ or a judicial organ.The nature of political organs marks the political attribute of the supervisory committee itself.The supervision law of the people’s Republic of China stipulates that the supervisory committee should exercise its supervisory power independently in accordance with the law,which reflects the legal attribute of the supervisory committee.A correct understanding of the dual attributes of the supervisory committee is of great significance to the practice of the reform of the supervisory system.This paper will explore the dual attributes of the supervisory committee from the following aspects.The article is divided into seven chapters.The first chapter is the significance of the topic and the current academic research status of the supervisory committee;The second chapter introduces the composition and function of China’s supervisory organs since ancient times by using the historical research method,so as to explore the direction of the change of the supervisory institutions and to highlight the historical necessity of the joint office of the supervisory committee in the reform of the supervision system;The third and fourth chapters,through empirical analysis and comparative research,analyze the political attributes of the supervisory committee from the aspects of the national political system,organizational structure,power operation and internal Party regulations;The paper demonstrates the legal attributes of the supervisory committee from the aspects of laws and regulations,power guarantee and organization operation;The fifth chapter expounds the rationality of dual attributes by demonstrating the relationship between the dual attributes of the supervisory committee;The sixth chapter discuss the superiority of the supervisory committee as a political organ,the leadership of the Communist Party of China is the biggest advantage of the socialist system with Chinese characteristics,and the establishment of the national supervisory committee is due to the political situation with Chinese characteristics and the demand of the anti-corruption era.
