Study On The Protection Of The Rights Of Private Charitable Donation Donor

In recent years,with the rapid development of fund-raising,private charitable donation has played an important role in the indispensable.Human rights guarantee is the key link of the orderly development of private charitable donation.Therefore,based on the current situation and reasons of the donor exercising rights obstacles,through security and public welfare donation and human rights foreign comparative analysis,to build and improve our system of protection of the rights of the private charitable donation donor.In addition to the introduction and conclusion,there are five parts in this paper:The first part of this paper focuses on the basic theory of law to give an overview of the private charitable donation.Combined with the new "charity law" provisions,the concept of the private charitable donation to the new definition,discusses its classification and characteristics,which will be divided into "mutual aid" private charitable donation behavior and self-help behavior,to the concept of support for the deep analysis of the.The second part is about the research on the legal nature of private charitable donation.According to several theories of domestic scholars dispute,respectively on the two types of private charitable donation behavior legally,the conclusion is "mutual aid" behavior is self-help behavior and donative contract is attached obligations,but also the innovation of this paper.The third part introduces the connotation,the nature of private charitable donation and the main types of human rights.This paper expounds the rationality of the existence of the rights of the donors,and makes a brief introduction to the legislation related to the rights of charitable donors at home and abroad,so as to broaden the ideas for the following institutional conception.The fourth part of the combination of the reality of the case,analysis of the main problems of private charitable donation exists,it is pointed out that the causes of the disorder of the exercise of the rights of donors,and discusses the conflict of rights and the phenomenon of private charitable donation,which paves the way for the following to avoid conflicts through the system.The fifth part is the focus of this paper,puts forward some suggestions for the protection of the rights of private charitable donation donors,involving the donation information disclosure,donation balance ownership to deal with the problem,and put forward the reasonable system conforms to the national condition from the tax incentives,supervision,accountability and other aspects,in order to promote the efficient and orderly development of China's private charitable donation cause.
