The Research On The Protection Of Farmers' Interests In Land Management Right Trust

In order to give farmers more rights,the government presented the conception of“three-power split”,which aimed to reform the rural rights.The land management right trust is carried out under this background,and practice cases have been done in our country,achieving great economic and social results.However,theory has been fallen behind practice,the lack of theoretical research and regulations lead to adverse consequences that makes the functions of land trusts incompletely fulfilled.It can't be denied that land trust as a new way of land transfer is conducive to improve our land transfer mechanism and promote the allocation of resources and entitle the farmers more property rights.Therefore,how to seize the chance of developing the advantage of land trust needs theoretical breakthroughs.It is of great significance to explore the risks of land trust and to formulate risk prevention measure to protect the legitimate rights and interests of farmers,and promote economic growth in countryside.Under the division of three rights,the paper analyzes the practice of land management trust on the basis of literature review,so as to explore the legal matters that affect farmers' interests.This paper also discusses how to build a effective institutions on land management trust according to existing law.From both entity content and procedure content,the paper summarizes the risks of affecting farmers' rights.The standardization of law systems is the foundation of healthy and effective land management trust.In the construction of law system,according to the law issues in entity content and procedure content,the construction and development of legal system has been discussed,including the establishment of land trust service fund,improvement of risk bearing mechanism and other kinds of measures.Besides,this paper also has a deeper understanding of financial support in rural construction so as to provide some reference in land trust.
