Research On The Protection Of Farmers' Rights In The Land Management Trust

In recent years,as the process of urbanization has accelerated,more and more farmers have gone out to work.A large amount of rural labor is lost and large areas of idle land appear.Traditional land transfer mode has been difficult to solve the problem of agricultural land.Since the implementation of the trust law in China,Land management right trust has achieved great development,and the practice has been carried out all over the country.However,Farmers lack sufficient understanding of the land management right trust,the relevant rights and obligations are not familiar with the content,and China has not yet formulated the relevant legal system of land management right trust,Farmers' rights in land management rights trusts cannot be effectively protected.Therefore,in order to protect the legal trust rights of the farmers in the land management right trust and promote the further development of the land management right trust system,This article uses literature research methods,normative analysis methods,and empirical research methods.Based on the policy background of the "Separation of division" to rural land management of the trust relationship in the view of farmers rights protection and the related content of farmers in land management of the trust are summarized,and on the basis of the analysis of the current our country land management in the practice of the trust is bad for farmers rights protection problems,put forward the corresponding legal advice.The full text is divided into four parts: the first part is introduction,mainly introduced the research background of the article,using the empirical analysis method put forward in the practice of land management of the trust problem of farmers' right to damage,and literature review,this article introduces the research methods and thesis structure.The second part,the article uses the method of literature review for defining the relevant concepts,through the analysis of the scholars of different views of the concept of land trust,summed up the nature of the trust property is the main focus of the dispute.Based on the "three-power separation" policy,this paper makes an argument and analysis,and puts forward the concept of land management trust with the right of management as the trust property.At the same time,the farmers' rights in the land management trust are summarized.The third part mainly points out the existing problems of farmers' rights in China's land management trust,and analyzes the reasons.For example,farmers' active choice,farmers' right to know and supervision are damaged,and the subject of trust law is uncertain.It is mainly due to the imperfect laws and regulations in China,the lack of understanding of the trust of farmers and the lack of awareness of rights protection.The fourth part,based on the analysis of the problems and reasons,put forward the perfect relevant laws,to establish relevant land registration system in our country,perfect the rural social security system,to enhance law consciousness of farmers Suggestions,in order to achieve effective to protect the rights of farmers.
