Study On Students' Injury Accidents In Physical Education

The frequent occurrence of injury accidents in physical education not only seriously affects the healthy growth of the students,but also brings great harm to the school and the family,and has a negative impact on the society.It is more likely to impede the healthy development of physical education and even the physical education of the school.By means of literature analysis,case analysis and statistical analysis,this paper studies 184 civil judgment documents on the cases of injury accidents in physical education,in order to explore the time,region,cause,injury degree,group special point,procedure,application and referee of the cases of injury accidents' results and other aspects of the status and law in physical education;analysis of the people's court in the case of fact finding,the application of the law,the results of the judgment,and further strengthen the attention of the social parties to the injury accidents in physical education,and guide the parties to solve the disputes rationally according to law.Research shows: autumn is the students' injury cases in high season,April and December is the first instance cases up to the month,the incidence of cases was significantly higher than that in the morning afternoon;frequent cases of highly concentrated regional characteristics;victims groups are highly concentrated in person with limited capacity for civil conduct(compulsory Education);constitute disability the largest proportion of cases,the proportion of ordinary injury can not be ignored;the mixed cause is a major cause of the injury accidents of students,and the factors of the "people"("PE teacher factors")the proportion of the court;mainly used "tort liability law" article thirty-eighth and thirty-nine define the liability of school to bear for twenty-fourth,determine the school students loss sharing proportion;at the same time,there is an error for the "tort liability law" Tenth Six articles and thirty-ninth articles and ninth articles in "the interpretation of compensation for mental damage".Suggestions: perfecting the sports legal system,to lead and promote the reform of school physical education,to promote and protect the development of school sports,to provide a good legal environment for the healthy development of the school sports teaching;strengthen the administrative super vision,school leadership responsibilities,compaction to improve the PE Teachers' attention to students' injury prevention and treatment of accidents,to provide a good environment for the healthy campus the development of school physical education;unified judicial measure,promote judicial justice,to provide a good legal environment for the school sports teaching;improve the school sports injury insurance system,and the sports injury students teaching into the scope of national compensation,economic compensation pressure from the school,for the development of sports teaching in school sports and relaxed;strengthen teachers,the students' risk awareness,legal awareness,enhance the ability to deal with the risk of sports To improve the consciousness of the rule of law and to guide the students' legitimate reason for the injury of the accident to solve the disputes.
