The Free Trade Zone is the region with the highest level of market liberalization and trade liberalization in the world.It focuses on increasing the circulation of goods in the free trade zone,but it must not be reduced to a place where intellectual property infringement is rampant.The enforcement of intellectual property rights in the Liaoning Free Trade Zone is a new exploration.It needs to explore new law enforcement models,and the work is difficult and demanding.In the beginning of the exploration of the intellectual property rights enforcement system in the Liaoning Free Trade Zone,we must clarify the differences between the Liaoning Free Trade Zone and other free trade zones in the world firstly,the content of the intellectual property rights in the Liaoning Free Trade Zone and its own particularities.The Liaoning Free Trade Zone is not only responsible for the adjustment of tariff policies,but also undertakes the exploration of accelerating the transformation of government functions,deepening the opening up and innovation of the financial sector,and improving the openness of social services and the construction of the legal environment.Bridgehead first try first.The Liaoning Free Trade Zone is positioned to focus on improving the overall competitiveness of the old industrial bases in northeast China and the new engine for opening up to the outside world.Intellectual property law enforcement will undoubtedly play an important role and play a greater role.The exploration of the intellectual property rights enforcement of the Liaoning Free Trade Zone is essentially an institutional innovation regarding the enforcement of intellectual property rights.The Liaoning Free Trade Zone has,under the precondition of “preemptive testing first,” has stepped up its efforts to break the shackles of Liaoning's comprehensive revitalization and development in terms of systems and mechanisms.It has “preliminarily tried” the reform of the intellectual property rights enforcement system to resolve the current problem of intellectual property administrative systems,Decentralized management,leading to the problem of non-smooth operation mechanism,accelerating the establishment of a law enforcement system for intellectual property rights in the Liaoning Free Trade Zone,increasing the protection of intellectual property rights in the free trade zone,and alleviating the obstacles caused by intellectual property disputes in the Free Trade Zone.The reform and development of the trade zone is better.At present,the development of the Liaoning Free Trade Zone is still in its infancy,and there are still many practical difficulties in constructing the intellectual property rights enforcement system of the Liaoning Free Trade Zone.The enforcement of intellectual property rights in the Liaoning Free Trade Zone is not only imperfect in the top-level system,but also requires the establishment of new law-enforcement agencies,as well as more complex law-enforcement links,as well as diversified enforcement standards and complicated enforcement targets.It has made it difficult to increase the difficulty of law enforcement,the current law enforcement model is no longer feasible,and the construction of a new law enforcement system is imperative.Through the analysis of the status quo of intellectual property rights enforcement in the four major free trade zones established in China in Shanghai,Tianjin,Fujian,and Guangdong,we summarized the progress from entities to procedures.Based on this,it puts forward the proposal to constructing the intellectual property rights enforcement system in Liaoning Free Trade Zone.First of all,we must complete the top-level design of intellectual property rights enforcement in the Liaoning Free Trade Zone to achieve legal administration.It is proposed to formulate local laws and regulations on the enforcement of intellectual property rights in the Liaoning Free Trade Zone,and clarify the powers and responsibilities of the intellectual property rights enforcement body in the Liaoning Free Trade Zone.Secondly,in terms of the main body of law enforcement,it proposed to establish a “three-in-one” intellectual property office and cooperate with Customs in law enforcement to explore and establish a dual enforcement mechanism for intellectual property rights.Again,the object of law enforcement in the Liaoning Free Trade Zone will be differentiated according to the trade pattern,and the law enforcement standards will be established in line with international standards.Finally,the law enforcement procedures are designed in conjunction with the dual-cooperative law enforcement model and the special customs clearance model of the “first line” and “second line” in the Liaoning Free Trade Zone.
