Research Report On Compensation And Resettlement Of Collective Land Expropriation In Xinjiang New Area

The expropriation of collective land is popular in this ten years,as a series of violent expropriation of land causing many serious consequences,the local government pay more attention to compensation and resettlement of the collective land and behave more regulated,these protect more rights of farmers.However,many problems,such as the agreement of land expropriation between the government and farmers did not come true,the government did not perform as they promised in the agreement of the expropriation of the land.Even more,the government blame the farmers the failure of performance of the agreement and the absence of objective conditions,this lead government lost credibility of farmers.Although the farmers fight for their legal rights in legal ways,they cannot get remedies.Therefore,it is necessary to legislate some unity rule of the collective land expropriation law to ease the contradiction of the expropriation as there is absence of clear principle of the collective land expropriation and its compensation and resettlement,even though the local government has legislated the relevant law.In addition,it needs to enhance the supervision of the superior government to the behavior of the expropriation and to promote farmers protect their legal rights.The government must fulfill the commitments and give legal aid to farmers to ensure they can gain legal remedy when they are infringed.
