Deep link technology changes the way that traditional links display works.Specifically,users can enjoy and download the content without skipping to the original website.The trend of the right edition of works makes it impossible for the chain website to investigate the tort liability of chain owners through indirect infringement.Therefore,whether the behavior of deep linking constitutes the direct infringement of information network transmission right has aroused wide discussion in academic and practical circles.In the first chapter,it explains the nature of deep links from the technical level and examines the copyright dispute caused by deep links.Then,it introduces the different juridical reasons and results of different judges in hearing deep links cases,and expounds the views and reasons of the dissident scholars about whether the deep link constitutes a direct violation of the right of information network transmission in China.Further,the focus of the controversy is summarized in the difference between the understanding of deep links and the interpretation of information network transmission right in China.The second chapter makes a detailed interpretation of the right to network dissemination of information by means of historical interpretation,comparative law interpretation and semantic interpretation under the premise that it applies to the rule of exclusive rights protection.Then,this chapter explains and analyzes the referee standards,including “user perception standard”,“substantive presentation standard”,“substantive alternate standard”,“server standard” and “legal standard” for the direct infringement of information network transmission right in China's judicial practice.It further clarifies the correctness of the application of "server standard" in the case of information network transmission right in China.The third chapter,through the understanding of the deep link in the first chapter,and the interpretation of the communication right in the second chapter,concludes that the deep links does not constitute a direct violation of the right of communication in China's information network.From right boundaries,technology development,works dissemination and market competition order,this paper discusses the possible negative effects of the assumption that deep links directly infringe on the right of information network transmission in China.The fourth chapter is an attempt to find ways to regulate deep links in the framework of copyright law in our country in order to solve the copyright disputes caused by deep link technology under the Internet environment.It tries to regulate the behavior of displaying the works to the users in the internet environment by using the technical protection measures,broadcasting rights and the right of mechanical performance in the copyright law of China.Besides,the disadvantages and advantages of the above three regulation methods are analyzed and by integrating the right of communication,a new "right to public communication" is formed.All acts that disseminate works in wired and wireless ways are included in the regulation scope of the right,including the act of displaying works to the public through the deep link technology,and other inextricable communication problems in the existing copyright law can be solved by this new public communication right.
