Legal Regulation Of Deep Link Behavior In Network Communication

In the Internet age,huge amounts of information and works resources are spread and shared among users through network link technology,and the development of deep link technology saves users the trouble of bouncing back and forth between different websites,thus accurate search and positioning to target information and works,and promote the efficient and flexible operation of Network Communication,it is undeniable that deep link technology as an emerging technology means has very important positive significance,but at the same time,it has also brought about a series of problems,especially in the area of copyright protection,the Act of a Web service provider to directly present a work stored on a medium such as a third-party server to its own page using deep-link technology,so that the user does not need to return to the source site to access the work directly,it should be controlled by the right of information network dissemination,and should be regulated in judicial practice.This paper first expounds the basic problems of deep link behavior,introduces the basic concepts,technical features and classification of deep link,and then expounds the related improper behaviors,then it deeply analyzes the legal liability of deep link,and measures the tort of deep link under the framework of Tort Liability Law.In addition,the author analyzes the evaluation criteria of deep link,a brief introduction is given to the various criteria for determining the infringement of the deep link act in the theoretical circle and judicial practice,so that on the basis of referring to the relevant legislation and judicial experience of foreign countries,this paper puts forward some problems existing in the legal regulation of our country,such as the imperfect legislative protection of the right of information network dissemination,the inadaptability of the standard of infringement cognizance to the development of new technology,and the insufficiency of the compensation for infringement damage,etc.,finally,some solutions and suggestions are put forward to solve the related problems.In a word,deep link is a new network technology that adapts to the development of the times,integrates the Internet resources effectively,and makes a contribution to the information sharing.However,there are still some problems in the process of its development.Only by solving these problems reasonably can we give full play to the value of deep link,protect the legitimate rights and interests of the parties concerned,and realize the harmony and stability of the society.
