Study On Legal System Of Compulsory Liability Insurance For Food Safety

Since 2008,Sanlu milk powder scandal at the beginning of the food safety issue has been of concern,although the problem of food safety management and the government through frequent media exposure after the convergence,but did not fundamentally eliminate,Shuanghui clenbuterol event,Nestle milk powder and other food safety incidents still occur.The significance of this study is not how to curb the recurrence of food safety problems,but how to better deal with the adverse effects of food safety problems and maintain economic and social stability.Specifically,through the method of Establishing Compulsory Insurance System in the field of food,in order to solve the problems in practice of the victims did not receive timely relief and compensation in food company bankruptcy problem,alleviate the enormous financial pressure in the face of the government food safety accident should bear.This paper is to study the legal system of compulsory liability insurance of food,including is divided into five parts in structure: introduction,food safety liability insurance system construction of basic theory,the necessity and feasibility of general ideas,detailed design and system construction of the conclusion.The first part is introduction.The main research methods of the article introduces the research background and significance,domestic and foreign scholars on compulsory liability system for food safety are simple comparison,sort out the current academic compulsory liability system of food safety,and summarized briefly their own point of view on food safety compulsory liability system.The second part of the basic theory of compulsory liability insurance for food safety.First,the concept of food safety compulsory liability insurance is annotated,and on this basis,the characteristics of the system are summarized,so as to analyze the theoretical basis of supporting food safety compulsory liability insurance system,and provide theoretical basis for the whole system.The third part discusses the necessity and feasibility of the compulsory liability insurance system for food safety.The necessity part is mainly discussed from three angles,including consumers,food producers and managers,and government responsibilities.The feasibility part is demonstrated from the aspects of market,pilot,public opinion and similar compulsory insurance system.The fourth part discusses the general idea and specific design of the system construction.This part is the core part of this paper,the general idea first established the basic principle of the system,namely the protection of victims,compensation and balance protection principles,specific rules to guide the establishment of the principle of food safety compulsory insurance system operation,then the system of legislative mode and operation mode has also made a brief arrangement.In the specific design part,we first define the scope of the insurance subject,then focus on the definition of the scope of the insured body.Then we discuss the way of implementation,the responsibility,the rate,the claim and the auxiliary mechanism.The fifth part is the conclusion of this paper.Through a series of discussions on the legal system of compulsory liability insurance for food safety,the system can run smoothly and effectively.The first compulsory key food business insurance,according to the operation condition of system and gradually expand the coverage of the main range,so that more food enterprises into the system,in order to achieve food safety liability insurance system in the field of food security function,so as to realize the protection of the safety of people on the tongue.
