The Construction Of Legal System Of Food Safety Responsibility Compulsory Insurance

Food security relationship between the people’s life safety and health, in recentyears, food safety accidents occur frequently, food safety problems caused the extensiveconcern of the people. Food safety after the accident, how to make consumers get timely,full and effective relief and compensation has become urgently needs to solve theproblem. Food safety compulsory insurance, as a kind of liability insurance is based onthe victim’s timely rescue of food safety accidents, compensation as the core, at the sametime also can disperse the enterprise the management risk, reduce the government’sfinancial pressure, is of great significance. In this paper, centering on the construction offood safety liability compulsory insurance system, construction of food safety liabilitycompulsory insurance in our country are analyzed and the necessity and feasibility ofproposed system preliminary ideas.The full text is divided into four chapters, about thirty-three thousand words.The first chapter is about the summary of food safety liability compulsory insurance,this paper introduces the related concepts of food safety and food safety responsibility,further illustrates the meaning of food safety liability compulsory insurance and features,analyzes the food safety liability compulsory insurance to the traditional theory ofbreakthrough and innovation.The second chapter emphatically probes into the construction of food safety liabilitycompulsory insurance in our country the necessity and feasibility. From the developmentof food industry, consumers’ rights and interests safeguard, enterprise risk transfer andthe burden of government can reduce the four aspects to analyze its necessity; From alegal policy support, the development of liability insurance market situation and practicalexperience making these three aspects to demonstrate its feasibility.The third chapter introduces the developed country and the area of food safetyliability compulsory insurance system, and based on these countries and the area of food safety liability compulsory insurance system analysis, put forward to construct foodsafety liability compulsory insurance system in China.The fourth chapter, based on the above three parts to construct food safety liabilitycompulsory insurance system in our country from two aspects of the basic ideas andspecific operation system preliminary design is put forward. Basic concept includeslegislative basis and legislative principles, and the concrete system from the main body,management pattern, the limitation of liability, the rate setting, compensation method,regulation and relief the following six aspects in this paper.
