The expiration of the right to use the residential land for 20 years in Wenzhou has caused widespread concern in the whole society.This event reflects the problem of the renewal of the right to use the land for residential construction in China.The Wenzhou incident caused the people to worry that their rights could not be guaranteed when the right to use the land use right to expire in the future,and appealed to the state to formulate laws and regulations to ensure that the legitimate rights of the residents were not infringed.This article,based on the status of the right to use the land for residential construction system in China,summarizes the existing problems in practice through the study of relevant literature and the implementation of the system in practice,and puts forward some solutions to these problems.I hope this paper will contribute to theoretical research and practical experience in the practice of this system.This article is divided into three parts:The first part is an overview of the system.The first part is the definition of the relevant concepts of the system,and points out the characteristics of the right to use the residential land in our country,that is,the time limit.Then it introduces the provisions of the time limit of the system in China and the historical reasons for the formation.Finally,it introduces the provisions of the current law in China.The second part is the practice and existing problems of the renewal system.First,the practice of the system is introduced through the case,including the practice after the expiration of the period of the Ali Mountain Area in Qingdao and the expiry of the period of the Great Wall Building in Shenzhen.And then summarize the problems reflected in the practice,such as whether the renewal is paid,how to determine the renewal cost,the number of applications for renewal,the legal consequences of not applying for the renewal of the term.At the same time,we will comb all suggestions for these problems.The third part is the focal point of this paper.Aiming at the problems and viewpoints in the second part,I will draw on all sides' viewpoints and put forward some operable suggestions.The proposed suggestions are mainly in the followingaspects: First,determine the automatic renewal for a paid renewal;Second,the reasonable determination of the renewal cost;Third,the application for a renewal of one time;Fourth,the exercise of the rights of the unpaid continuation is limited.
