Study On The Subject Of Traffic Accident Liability For Online Car-hailing

In recent years,with the rapid development of the Internet O2 O industry,online car-hailing has become one of the main ways for the public.But unlike other O2 O industries,online car-hailing has a higher risk of off-line services.And at the same time,there are many frequent traffic accidents.However,because the online car-hailing is a new thing,it is very different from the traditional subject of responsibility for traffic accidents.In judicial practice,there are different judgments about the responsibility of the traffic accidents and the liability of the traffic accidents in the judicial practice.The academic circles also have different opinions.This article mainly study the subject of the online car-hailing's traffic accident liability by analyzing related cases,in order to provide a certain reference for judicial practice.This article is divided into five parts: introduction;basic situation of case;legal analysis;conclusion and thinking;epilogue.The first part is the introduction.It mainly expounds the research background and significance of the topic,the research status of this topic at home and abroad,and the methods of thesis research.The second part is the basic situation of cases,and briefly introduces the four typical cases selected in this paper.The third part is the legal analysis of the cases.Through the categorization of the mode of online car-hailing employment in the four cases to discuss respectively the relationship between the platform of online car-hailing and the drivers of online car-hailing,and the liability subject of various types of online car-hailing accident.The fourth part is the conclusion and thinking.It specifically analyzes the problem of the identification of the liability subject for online car-hailing traffic accidents under different modes,and draws the analysis results;then it proposes some suggestions for the problems existing in the legislation and judicial practice of online car-hailing.This article focuses on the subject of the responsibility of the accident affair under the mode of private cars,in particular,how the relationship betweenthe platform of online car-hailing and the driver of private car under this model should be defined.
