Research On Legislation Of Environmental Crime In China

With the rapid development of economy,the environment for human survival has been seriously polluted and destroyed.Facing the increasingly serious environmental problems,the civil law and administrative law play a more and more weak role in environmental protection.The protection of the criminal law of the environment has received unprecedented attention from various countries.China in 1997 in the "People's Republic of China criminal law" the sixth chapter "the crime of disrupting the order of social administration" set in the environmental crime,positive progress has been made in environmental crime.But in our country,criminal legislation style of environmental criminal law,crime arrangement,environmental criminal liability,and environmental crime subject scope,there is still a gap between the reality and the need of environmental protection.The comparison of domestic and international situation of environment legislation,this paper thinks that the perfection of environmental criminal law,perfect the legislation of environmental crime system,standardize environmental charges,expand the scope of environmental protection,clear environmental crime accomplishment standard,setting reasonable penalty aspects to improve China's environmental crime legislation.This article contains text and epilogue,is divided into 7 chapters,first,through the introduction of the research background and significance of environmental crime,domestic and foreign research status and research methods.Secondly,the text is divided into the environmental crime overview,China's current environmental criminal legislation of environmental crime in our country,the development trend of foreign environmental crime legislation for our country and improve China's environmental crime legislation five chapters to explain.Hope to have some reference significance to our country's environmental legislation,so as to better realize the protection of the environment.
