| According to Tocqueville,a French revolutionist,the jury system is not necessarily a democracy at first.In our country,there is a political democracy that regards the people’s jury system as a tool,and there is also a judiciary that has substantial democratic values.However,in any case,it must be a procedural system with democratic values.The system of people’s assessors has experienced disputes over “preservation”,“waste” and “improvement” on Chinese land.The system structure is not perfect,the value selection is not clear,there is no supervision mechanism,and the unsolvable judicial costs lead to the system of people’s jurors.The origin of controversy is the origin of controversy,and as a starting point in deciding whether the system of people’s jurors has been run,the range of cases involved in trials has led to a new round of practice and institutional separation due to construction defects and ambiguous legal regulations.The pilot reform attempted to focus on reforming the scope of people’s jurors’ case participation and seeking a reasonable range of cases for participation so that the system could exert its own value.However,as far as the current level of justice is concerned,the court has absorbed people’s jurors to participate in the trial.Its focus is mainly on increasing the transparency of the judiciary and expanding public participation in judicial work.In the later stages of the development of the system,judicial supervision and the improvement of trial efficiency,such as the choice of a low-value level,will give rise to judicial democracy and judicial justice at a high-value level.Based on this,the dissertation expounds how to reasonably determine the scope of the people’s jurors in the trial,and from the current judicial status quo and judicial tasks in China,itproposes that the scope of the cases for which the parties apply for jury should be expanded.In the end,the paper proposes ideas and suggestions on how to improve the scope of the people’s jurors in our country from both the root exclusion obstacles and the exclusion of specific institutional design obstacles. |
