Research On The Policy Of Strictly Restrictingthe Death Penalty

The death penalty policy is the guiding principles and policies and guidelines for action that made by a state,it is for the legislation and justice of the death penalty.It is the soul of the death penalty rule of law.At present in my country,strict limits on the death penalty is a guidance policy for the application of the death penalty.It is the inevitable choice between whether to abolish death penalty.This is a criminal policy that based on a correct understanding of advantages and disadvantages of the death penalty,and of the present situation of our country.It runs through the death penalty legislation and judicial process.The instructive policy based on an analysis of advantages and disadvantages of the death penalty,and our party having grasped the value connotation of the limitation of the death penalty and holding our country's specific history and actual national conditions.This article is divided into four parts.In the first part,this paper discusses the definition and connotation of strict restrictions on capital punishment,it based on an accurate understanding of the concept and connotation of capital punishment and capital punishment.This part expounds how to restrict the death penalty policy strictly,and its superiority and its superiority compared with the death penalty.The second part has written the policy of strict restrictions on capital punishment how to carried out in the rule of law in China in two ways of the embodiment of China's legislation and the embodiment of the judicial application in our country.In the third part,start with each specific crime,analyze the problems existing in our country's practice of strictly implementing the death penalty policy,and the reasons of these issues should be further implemented to strictly limit the death penalty policy.According to the scientific structure of find problems and solve it,in the fourth part of this article,put forward some methods to solve the problems in implementing strict restrictions on the death penalty policy from the aspects of legislation,justice,penalty structure and related systems.
