| The 18 th Plenary Session passed “the Decision of the CPC Central Committee on Promoting the Rule of Law in an All-round Way on Certain Major Issues”,and it stressed the significance of the Comprehensive rule of law.China’s reform has entered the period of critical and the deep water zone,the research on the thought and construction of the rule of law has become more and more prominent.We must go back to the source and have a grasp of Chinese classical legalism thoughts to study the rule of law.Thought of Legalism was a significant strategy of Chinese national governance mode aiming for a prosperous and powerful nation in the world,also an instruction book of being a qualified king or servant.The thought can be found in a book named Hei Feizi,written by Han Feizi.Based on the background of the new era of comprehensive law,the mainstream ideology of China and the inheritance of Chinese traditional culture demands,the essay may enlighten for the present study of the rule of law in China such as the construction of the discipline of law,the ascension of the status in the major ideology,and the instruction of the governance of the comprehensively implement the rule of law.The main part of this paper is divided into four parts: Forming process,Main content,Basic features and Contemporary enlightenment.Han Feizi Thought can be concluded as The social evolution thought of "law changes at any time" in the legalism thought,the "law-first" thought of the rule of law,and the objective thought of "artistic and imperial",the concentration of power thought of "strengthen base and weaken branches" and the dialectical unity thought of "trinity of law,matter and power".According to it,the characteristics of content include the progressive characteristics of the times,the restricting characteristics of justice,the recessive characteristics of profitability,the superiority of exclusive respect,the dialectical unity,and the orderly characteristics of the rule of law practice.The thesis puts forward several reasonable proposals to build the rule of law in China such as awake people’s awareness of laws,take full advantages of the democratic centralism,optimize the mechanism using and promoting talents,and handle the relationship between central and local governments by means of literature research,historical analysis and theoretical versus practical study.T he thesis is the study on Han Feizi Thought and Its Enlightenment for the Rule of Law in China aiming at further study. |
