Research On The Legal Issues Of The Charging Right Securitization In Chinese Colleges

Asset securitization is an innovative financial method in recent years,which can change the financing predicament of colleges in China.Therefore,in recent years,more colleges have begun to use this novel financing method to improve their financing predicament.This paper mainly focuses on the financing status of the charging right securitization in Chinese colleges.From the perspective of law,the paper focuses on the operation mode of the charging right securitization in Chinese colleges.And finds out the problems,and then analyzes the problems and solves them.This paper is divided into four parts.The first part is the overview of the charging right securitization in Chinese colleges.In this part,firstly,I introduced the basic theory of asset securitization,including: the concept,characteristics and developing situation of asset securitization.Secondly,I analyzed the feasibility of the securitization in Chinese universities,and then introduced the application of the securitization in Chinese universities.In the second part,I focuses on the typical case of asset securitization in China-"the special plan of asset support of jinqiao college".firstly I introduced the basic situation of "the special plan of asset support of jinqiao college",Including: basic assets,participants,transaction structure,credit enhancement mode.Secondly I analyzed the operation pattern of "the special plan of asset support of jinqiao college",and to discover the strengths and weaknesses of the project.The third part mainly analyzes the legal problems that arose in the practice of the securitization in Chinese colleges.There three legal problems I mainly analyzed in this part,the first is the defects of the charging right as the basic asset;The second is the bankruptcy risk isolation mechanism of the asset support special plan is doubtful;The last is the credit enhancementcannot effectively isolate risk.The fourth part is mainly to solve the problems.In view of the legal problems that arose in the practice of the securitization in Chinese colleges,some Suggestions are put forward.
