Under the background of global vigorous promotion of green environmental protection and energy conservation,our government and enterprises from all walks of life actively advocate the development and application of new energy technologies.In order to seize business opportunities in the new energy outlet,charging service enterprises have been acquiring land to construct charging piles in an attempt to make profits.However,there are many problems in the acquisition of construction land for charging piles.The central and local governments actively explore the new mode of construction land for charging piles.In 2016,Guangdong Provincial Bureau of Land and Resources explicitly put forward in "Several Opinions on Guaranteeing the Land for Electric Vehicle Charging Infrastructure Construction Projects",that we should dare to break through the traditional mode of construction land for infrastructure such as charging piles for electric vehicles,and create new ways to promote charging service enterprises to obtain easement according to law.Conduct construction.Encourage first try and dare to break through.Local charging service enterprises are also actively trying to use easement system to solve the dilemma of charging pile construction land.Based on the social practice of charging pile construction in Guangzhou,this paper studies the ways to obtain the construction land of charging pile for charging service enterprises in China,and understands that at present,charging pile construction land can be acquired by transferring and transferring it to the owner of construction land,or by signing lease contracts with the owner of real estate to acquire the construction land of charging pile.The construction of charging pile has its own drawbacks.For charging service enterprises,the construction land of charging pile acquired by leasing is very unstable,and the construction land of charging pile acquired by allocation has certain limitations.The construction land of charging pile acquired by transferring is not practical and has been explained.The background of the introduction of easement system.The existing access to construction land for charging piles can not meet the actual needs of charging service enterprises.In practice,the proposal of using easement system in the existing legal system to solve the difficulties of acquiring construction land for charging service enterprises has been put on the agenda and implemented on a pilot basis.Through research and analysis,the comparative advantages of easement system are found,that is,easement can solve the current problems of construction land of charging piles by virtue of flexible site selection and property attributes,and whether the lessee and usufructuary can become the subject of easement,whether the building can become the object of easement and what kind of easement is needed in the specific application process of the easement of charging piles.Definition and other problems and their theoretical analysis.Completed in practice the use of charging pile easement to resolve the dilemma faced by charging pile construction land rational analysis and specific application of charging pile easement research.Finally,the study finds that the easement system can not only overcome the shortcomings of unstable land use and complicated approval procedures when charging service enterprises acquire construction land of charging piles by leasing and transferring,but also solve the problems faced by the establishment of the subject,object and the determination of the required service area.
