The development of the commodity economy has brought many conveniences to people and also brought about some new problems.Among them,with the emergence of a series of phenomena such as large-scale retailer’s infringement of entrance fees,irrational trading conditions,default on payment,and the irrational use requirements of Internet companies for their users,the concept of abuse of comparative advantage has rapidly entered.Public view.The relative advantage status is itself a reflection of the strength of both parties in the market competition.However,the fact that it was abused has caused damage to the relatively weaker party in the transaction and the entire market.Some scholars have conducted corresponding academic discussions on this issue and have admitted that the abuse of this advantage will have a very negative impact.It also disrupted the commodity market and also harmed the legitimate rights and interests of consumers.At present,related cases are usually regulated by the "Contract Law" or the "Anti-Monopoly Law." However,due to the existence of a certain value deviation,the handling of related cases has caused greater social controversy.Exploring and coordinating the relationship between the current law and this issue has become the subject of this article.The first chapter of this article aims to introduce two kinds of comparative abuse of comparative advantage that are currently common in our country.The second chapter focuses on the analysis of the application of the current law in solving the problem of abuse of comparative advantage,and finds out the current deficiencies in application.The third chapter analyzes the nature and legal interests of the legal regulation to solve this problem,and then discusses how to legally identify this behavior.The fourth chapter discusses the specific legal systems that can be adopted from different perspectives of civil and commercial law and administrative behavior.
