Study On The Quota System For Judges In China

The judicial system is an important part of the political system,The reform of the judicial system occupies an essential position in comprehensively deepening reform and comprehensively ruling the country by law,and the reform of the quota system for judges plays a big role in it.The content of the quota system for judges includes the verification of quotas,the selection of quotas,the adjustments of quotas and the withdrawal of quotas.Implementing the quota system for judges is a vital approach to improve judicial quality,efficiency and credibility,and it is the necessary way to promote the standardization,professionalism and specialization of judges.In the United States,Japan and other developed countries and regions,the system of judge quota has been in force for a long time and is very mature,which can provide us with useful experience for reference.We have put forward this reform from the late 1990s',but it is never have been done until the current reform.Just as the saying goes:“we have finished the reform of judges' quotas system which have been thought and spoken for many years.”This reform adhere to problem-oriented,adopts a method combining top-level design with basic exploration,The central government has clearly defined the basic principles,general requirements and core content of the quota system for judges,and the local government based on their ground,carrying out active exploration in terms of quota verification,leadership handling,support staffing as well as the dynamic adjustment and withdrawal of quotas.The reform has achieved the expected goal that the number of judges is streamlined,the overall quality improved,the strength to handle cases enhanced and the trial quality has been ameliorated.However,there are still some problem such as some policies are lacked of precision in implementation,and it remains to be perfect.In order to promote this reform,we need to further improve the method which exploring more accurate approach in quota verification as well as allocation;to strengthen the supporting facility that establishing the full employment court clerk team;to improve policy which promoting the quota system for judges more in line with the judicial practice;to consolidate the results and construct the long-term mechanism that prevents the backward route.
