Research On Copyright Protection Of Artificial Intelligence Creation

Chinese “artificial intelligence” is translated by English Artificial(artificial,simulated)Intelligence(intellect,comprehension,clever),as the name suggests,it is the subject that focus on the research and development about simulation,extension of human intelligence.In recent years,the "wisdom" of artificial intelligence has been changed rapidly,which has become a new talent in the field of literature and art.As a newcomer in the field of literature and art,the talent of artificial intelligence in writing the press release can save a lot of manpower cost and time cost for employing units,and the paintings finished automatically in accordance with the procedures by artificial intelligence are showing the ultimate visual feast for us.With the increasing popularity of artificial intelligence,the form of the press release,songs,paintings finished by artificial intelligence seems quite similar with the achievements of mankind,so can these results be protected by the Copyright Law? However,the works protected by the Copyright law shall contain human intelligence.There is human intelligence or not in the artificial intelligence achievements will affect the legal position of artificial intelligence achievements.This article will start with the artificial intelligence in the field of literature and art,to study the legal sense of artificial intelligence.The first part of this paper begins with the introduction of artificial intelligence,describes the development of artificial intelligence and introduces two kinds of artificial intelligence,which can be divided into weak artificial intelligence and strong artificial intelligence.This paper analyzes the unlimited potential and risk of artificial intelligence in the era of big data,and reveals the urgent situation of the protection of artificial intelligence for the development and stability of the society.The second part discusses the necessity of legal adjustment for AI results.This paper discusses the needs of investors,real industry and public demand for artificial intelligence.The rapid development of artificial intelligence needs to adjust the complex social relations involved by law.However,the research on law and related jurisprudence is in a blank state,and then the central topic of this paper is how to solve the instability of the legal state of artificial intelligence.The third part analyzes whether AI can be adjusted by copyright law.It needs to be clear whether the intelligent product has the attribute of the work.The author believes that although there is a certain degree of mismatch between the intellectual achievements and the definition of "works" in the current copyright law,the intellectual achievements should be protected by the copyright law from the perspective of the convergence of the artificial intelligence creation in the field of literature,art and Science in appearance with the "works".The fourth part,basing on the third part,the author makes clear that AI can be protected by copyright law and then begins the discussion of its copyright ownership.The author first discriminate the rights subject involved,and then draw on the foreign legislation practice,according to the weak artificial intelligence and the strong artificial intelligence classification,the author put forward the two types of artificial intelligence copyright protection mode.
