| In this paper,in order to protect the legal rights and interests of waste incineration plant BOT project for the purpose,through the combination of theory and practice,the characteristics of the power plant project and operation mode analysis of waste incineration power plant project,points out and analyzes the legal rights problems caused by waste incineration,both legal entities and legal procedures,in order to better safeguard the public the key to the interests,the interests of the government supervision measures to ensure the BOT project mainly means,administrative regulations and the measures to solve the dispute of contract means.In the substantive part of the law,the contradictions between the competent authorities and the franchisor may be based on the administrative laws and regulations and the contract law.The procedural part of the law and the way to deal with the disputes should consider the construction and operation of the project and the time of social benefit.It can not be postponed for the sake of dispute.According to different circumstances,the reconciliation,arbitration and litigation procedures should be applied accordingly. |
