Research On Antitrust Exemption System In Horizontal Monopoly Agreement Of China Property Insurance Industry

The primary stage of the development of China's insurance industry,with the main insurance business growing,competition is increasingly fierce,especially the property insurance industry,the vicious competition on price can hardly be avoided,the market is damaged seriously.In order to maintain the market order,the insurance regulator has strictly controlled the price policy,and has asked the local insurance association to organize the implementation of self-regulation and regulate the competition in the local market.Because of the lack of anti-monopoly consciousness,the industry self-regulation has evolved into an anti competitive behavior that restricts competition and divides the market.Therefore,the horizontal monopoly agreements caused by it have been severely punished by anti-monopoly law enforcement agencies.Starting from the motivation of this form of property insurance industry horizontal monopoly agreement and the meaning of existence,through the typical case of ZheJiang property insurance industry antitrust investigation and punishment,combined with the basic principles of antitrust law and the current legal system,from China's insurance industry development stage,industrial policy and competition policy,the particularity of property insurance multiple dimensions to explore the property insurance industry horizontal Monopoly Agreement applies to the "anti-monopoly law" regulation of immunity.Besides,the development process of exemption from the application of antitrust law in developed countries such as the US,Europe and Japan is studied in detail,which provides experience for China's property insurance industry to apply for antitrust exemption.This paper finally puts forward the technology for exemption of property insurance,the law enforcement exemption exemption form special transitional period and the institutional arrangements of specific recommendations,the reform and development of the insurance industry can hope to do a little help.
