Research On The Legal Application Of Protection Of The Rights And Interests Of Cemetery Buyers

The cemetery to China for a long time,no clear qualitative cemetery buyers and purchase behaviors,prompted a cemetery in the cemetery buyer once after purchase or purchase damaged will be difficult to get reasonable and lawful relief rights.In one case of a cemetery,the buyer of the cemetery has filed a lawsuit against the court for the specific punitive damages of the law.The author thinks that it is improper for the buyer of the cemetery to protect the rights by using the consumer protection law,and the acquisition of the right to use the cemetery is more like the ownership of the land,which is the property right of the life of use.Although the purchase of cemeteries is also an exchange of consumption behaviors,it is different from ordinary consumption,which is the special consumption behavior,which should be adjusted by the laws and regulations of real estate transactions similar to the nature of products and the property law including judicial interpretation.At the same time,it is suggested that the purchase of the cemetery should be a special system for the purchase of special activities,such as financial consumption,medical expenses,and so on,to protect the legitimate rights and interests of the people in the cemetery,to regulate the market in the country's cemeteries,to promote the reform of the mortuary industry.In this paper,four chapters,the first chapter tells the research purpose and meaning,the second chapter discusses the theoretical foundation of the cemetery protection of the rights and interests of buyers,buyers' rights and interests protection law,the third chapter discusses cemetery in the fourth chapter discusses cemetery buyers rights and interests protection system of the legal system is perfect.
