Research On Legal Protection Of Personal Information In The Network Environment In EU

With the rapid development of internet and information technology,information economy has rapidly emerged,and information resources have become the core factor of economic competition.While a large amount of personal information is illegally collected and processed,especially in the network environment.Therefore,clarifying the right to informational self-decision and regulating the collection and processing of personal information on the Internet by market entities have become the focus of legislation in most countries and regions.Nowadays,many countries and regions are committed to solve the problem of legal protection of network personal information.The European Union(EU),as a pioneer in the field of personal information protection law,had believed that the EU Data Protection Directive(Directive 95/46/EC)was unable to adapt to the development of network technology so as not to provide proper legal protection for network personal information,for which the General Data Protection Regulation was promulgated to replace the Directive in 2016.On the basis of retaining the contents of the original directive,the specific rules for consent,the right to be forgotten,and the right to data portability were specially added in order to provide higher legislative protection for network personal information.Apart from the introduction and conclusion,this paper is mainly divided into three parts.The first part is about the evolution of legislation on the protection of personal information in the network environment in the EU,where the reasons for the change from the EU Data Protection Directive to the General Data Protection Regulations and the new rules were introduced.The second part mainly analyzes the contents of the legal protection of personal information in the network environment in the General Data Protection Regulations,including the basic principles,the consent rules of the data subject,the rights of data subject.The third part is to reflect on the legislative defects existing in the legal norms of network personal information in China.In view of the fact that the level of legislation protection of network personal information in China is at its infancy,it is hoped that the EU's legislative experience can provide some enlightenment for the legal protection of network personal information in China.
