| The increasing number of international refugees and the way in which they enter other countries is not limited to land,and the sea has become another way for refugees to enter other countries.However,many maritime accidents often occur in this process.However,the lack of international legislation on the protection of refugee rights through land and sea in this process requires the necessary protection of refugee rights from the sea.First,under the new concept of protection of refugee rights in maritime law,the definition of refugee rights and maritime legal security is carried out to clarify the status quo of refugees at sea.This paper points out that the maritime law to be constructed to guarantee the rights of refugees is based on the specific rights guaranteed by international human rights law and humanitarianism,in order to distinguish the difference between the rights and guarantees of refugees at sea and other rights;The reason why the rights of maritime refugees need protection under specific maritime laws is the independence of maritime security,which includes the safety of navigation in voyage and the safety of persons in voyage.Secondly,to point out the international law basis on which the rights of refugees at sea should be protected: under the principle of non-refoulement,refugees should not be turned back,while the right of a coastal State to restrict the entry of refugees on the grounds of its own sovereignty or jurisdiction and on the basis of its power to do so on grounds such as endangering the social order of the coastal State or the lack of valid documentation prevents refugees who are in genuine need of asylum or assistance from obtaining effective asylum or assistance,(b)The violation of this international custom of non-refoulement;(a)In accordance with the duty of the State to rescue a refugee at sea,any State shall fulfil its obligation in the event of danger during the voyage and that the refugee is only a status and does not affect the enjoyment of his or her human rights as a person;Other refugee conventions drawn up by States to protect the rights of refugees need to be respected and applied by the international community.Thirdly,there are many difficulties in establishing maritime laws guaranteeing the rights of refugees: the lack of maritime laws guaranteeing the rights of refugees during the voyage by sea;For the reasons of applying the subject,the compensation and the lack of priority compulsory measures to save human life,there is a dilemma in the rescue of refugees.Interception measures taken by the State to maintain its social order.These are obstacles to the establishment of international maritime laws that guarantee the rights of refugees.Thus,the difficulties existing in the process of ensuring the rights of refugees are addressed in the formulation of maritime laws that specifically guarantee the rights of refugees,in the further improvement of the right to priority relief for human life,in the allocation of compensation for relief and in the establishment of a maritime fund,as well as in urging States to improve the application of the maritime interception system to protect the rights of refugees. |
