Research On Synchronous Recording And Video System In China

The purpose of constructing a synchronized recording and recording system is to curb the extortion of torture and ensure the legitimate rights and interests of suspects.The establishment of this system has extremely important significance in promoting the construction of the rule of law in our country and realizing judicial justice.The “Criminal Procedure Law” promulgated in 2012 passed the legislation for the first time to construct a synchronized audio and video system.However,due to the lack of corresponding rules of applicability,the operation of the system deviated from the original intention of the design,causing great controversy in the academic and practical circles.Therefore,this requires us to re-examine the system,analyze the problems existing in the system and improve it.This article intends to carry out an in-depth analysis of the existing problems of the system and improve it,making the operation of the system reach the original intention.This article takes the synchronous recording and recording system of our country as the research object,comprehensively uses the literature analysis method,comparative analysis method,and empirical analysis method to discuss in accordance with the general ideas of asking questions,analyzing problems,and solving problems.The first chapter introduces the background of the topic,and summarizes the relevant research status at home and abroad and summarizes it.Finally,it elaborates the research methods and the research's emphasis,difficulty and innovation.The second chapter mainly introduces the concept,characteristics and value of China's synchronous audio and video recording system.First of all,it defines the basic concept of China's simultaneous audio and video recording system,and discusses the basic characteristics of the system.Second,it mainly analyzes the value of the system.The third chapter clarifies the legislative status and operation status of China's audio and video recording system,and focuses on the problems existing in China's current audio and video system,such as unclear legal provisions,large flexibility of application,non-neutrality of recording subjects,and lack of legal attributes.Clearness,lack of clear rules for transfer and presentation,and backwardness of the custody system.The fourth chapter mainly introduces the extraterritorial experience of the audio and video recording system,and analyzes the enlightenment to me from the recording and video system in the United States,Britain,Australia and China.The fifth chapter focuses on the problems existing in our country's simultaneous audio and video recording system and puts forward corresponding suggestions for perfection.
