Research On Antimonopoly Problem Of Drug Pricing In China

With the continuous improvement of China's government management and market mechanism,China's drug pricing mechanism has also undergone a fundamental transformation.Therefore,before focusing on government regulation and regulatory measures,we should actively adapt to the transformation.The international competition of the drug market is becoming more and more intense.The health of the whole drug market directly affects the interests of all drug operators,and the pricing of drugs is mainly formed by the competition of the drug market.Under this special background,the monopoly behavior of drug pricing is different from other monopolistic behaviors.In order to improve the pricing system,it is necessary for us to carry out empirical research under the existing legal system,combined with the recent representative drug pricing monopoly cases.Starting with the drug pricing monopoly cases occurring in recent years in China and drawing on the experience of foreign drug antitrust regulation,this paper puts forward some suggestions on the legal regulation of drug pricing monopoly in China.The main body of the article is divided into four parts: the first part mainly introduces the history and mechanism of drug pricing system in China.This part mainly focuses on the history of China's drug pricing system and the introduction of China's drug pricing mechanism.On this basis,the second part puts forward the problem of monopoly on drug pricing in China.With regard to the monopoly of drug price,this paper analyzes the monopolistic behavior of drug pricing in various forms in China and the reasons for the monopoly of drug pricing in the case of specific cases.Thethird part mainly uses the comparative analysis method to compare the foreign drug pricing laws and regulations,and select the typical representative drug pricing monopoly cases in the European and American countries for deep analysis,in order to elaborate the reference content to our country.The fourth part makes a comprehensive use of theoretical and empirical analysis methods.In the aspects of policy,law enforcement and industry management,some suggestions are put forward to improve the legal regulation of the antitrust behavior of drug pricing in China.
