Study On Legalization Of Administrative Interviews

As a new system for building a service-oriented government and improving the credibility and implementation of our government,the administrative interview is a flexible method in administrative management and widely applied to many fields of administrative management.As a new type of flexible way of law enforcement,although in practice,administrative interviews play an very important role in administrative management,they have not aroused many attention and focus,where scholars pay less attention on this item.This article studies the normative legal documents in practice to explore the theoretical basis of the administrative interviews and the theory behind their rising,and then headed to classify the interviews into three types,such as Instruction mediation interviews,reconciliation interviews.Then it starts from those three kinds of administrative interviews to analyze the nature and definition of administrative interviews and take the interviews as a kind of independent optional administrative guidance.With the development of the research,the author dissected the contradictions of the future development in practice and institutional level.In practice,the legislative level of the administrative interviews is the lack of high level laws and regulations which has seriously impeded the development of the interviews.Lack of reasonable operating procedures has left the other party without procedural safeguards in the progress.It is also common that the administrative interviews have frequently be used and forced by the administrative power.Finally,in view of the problems in practice,combining the exploration and practice around the related theory from the level of legislation and system,it puts forward some suggestions under the rule of law and perfects the implementation process and supervision of administrative interviews,and gives those whose interest be violated through administrative interviews,the right to apply for lawsuit and compensation for damages.
