The Major Problems And The Countermeasures Research On Labor's Rights Protection Under The Structural Reform Of The Supply Front

Due to the declining trend of macro economy in China,a great number of problems,such as the overcapacity and structural contradiction,have begun to appear in various industrial sections.The most serious one of the problems is that supply side is not able to catch up with the change occurring in the demand side in time.For the purpose of shutting down the outdated production facilities,enlarging effective supply and realizing the transformation and upgrading of industrial structure,following a prudent research,the Central Committee of the Communist Party of China has made an important arrangement on promoting the structural reform of the supply front.General Secretary Xi Jinping first refer to the usage of “structural reform of the supply front” in his speech delivered in the 11 th meeting of the Leading Group for Financial and Economic Affairs.And he expressly said the government would implement five interrelated policy,namely,a stable macroeconomic policy,an accurate industrial policy,a flexible microeconomic policy,an effective reform policy and a guaranteed social policy in the Central Economic Working Conference on December,2015,which would work as the pillars for the development of china's economy,whilst he referred to another five missions for current economy development,including cutting overcapacity and excess inventory,deleveraging,reducing costs,and strengthening points of weaknessThe Central Committee of the Communist Party of China,the State Council and other responsible authorities have issued a series of circulars aiming at the structural reform of steel,coral and real estate sections.The government has also set clear requirements on the settlement of employees and protection of both labor's and corporate's entitlements.Besides,One hundred billion yuan in rewards and subsidies will be released by the central government,which will be mainly used to resettle employees laid off from these enterprises.Those initiatives can be regarded as the directions and basis for protection of labor's rights under the structural reform of the supply front.“Cutting overcapacity and excess inventory,deleveraging,reducing costs,and strengthening points of weakness” are important means to supply front structural reform,of which the purpose is to promote the optimal allocation of production factors in the market,to improve the structure of supply front,improve the quality of supply front.This reform will inevitably involve the diversion of personnel,laid-off workers,and especially the employment opportunities and the vital interests of workers.It is inevitable to bring huge impact and pressure on corporate and social stability.Therefore,how to keep a balance between the reform and employees' rights is a key issue in the reform.In the background of supply front structural reform,this paper attempts to use the related theory of Marx's social justice and labor relations theory,human capital theory,the theory of corporate social responsibility,harmonious society development theory in public management,and adopts literature research and fieldwork method of investigation and research in its analysis.The author intends to figure out the impact on the protection of labor's rights brought by this reform,make clear the content,problems and ways of labor's right protection,put emphasis on the positive role played by the workers' union,discuss the drawbacks of the related practice in Sichuan province and conclude with the solutions of problems aforementioned.
