With the Chinese urbanization rapid growth,The transfer system of the state-owned land access has been the main mode in our country.The development is useful for the land transfer system,but it also has some problems.One of this is the separation of land ownership and land use rights,land tenure is a term,How to do after the expiration of the right to use land? After the expiration of whether need to pay land leasing? If you need to continue pay,how to pay? Residential construction land use rights expire is related to the vital interests of the people and it will become a hot social focus on people's livelihood.Dealing with the good and bad of the rules: the overall situation of social stability and the long-term stability of the country.China's current law does not make clear provisions on these issues,the majority of the people can not answer the question.Around this problem,I mainly do the following work areas:The first chapter is the introduction,the first chapter suggest the context of the research and the research at home and abroad,as well as the research methods adopted in this paper.The second chapter is the residential land use rights on land premium payment issues,with the events in Wenzhou as the breakthrough point.This paper analyzes the concept and characteristics of the right to use residential land,It is proposed that the term of the right to use residential land has a permanent conflict with the ownership of state-owned land,which is the root cause of the problem.The theory of residential land use rights and housing security is also discussed.At the same time,it is mentioned that the law can not solve the problem in our country,and it lays a foreshadowing for the third chapter.In the third chapter,the author makes a deep analysis of the current legislative situation and existing problems of the right to use residential land in china.The fourth chapter of this paper is the realistic foundation of the payment of land transfer fees for the right to use residential land.This paper analyzes the problem from the current social reality.Including the burden of residents' income and land transfer fees,and the theory of the theory of paid renewal and the theory of renewal without compensation.The author analyzes and draws the conclusion of "paid conditional renewal".The necessity and feasibility of conditional renewal are also analyzed.The fifth part of the paper sets up rules on the basis of the principle of "conditional payment",and puts forward some views on how to renew the right to use the land.This paper discusses the establishment of the payment standard of the land use right of the land use right,the payment method,the number and the time limit.When I study this problem,I collect a large amount of documents and materials,and make a comprehensive legal analysis of the issue from the legal basis,social reality and so on.It is hoped that some references can be provided for the study of this subject.
