Since the emergence of the sharing economy,this innovative business model which based on the Internet has been continuously integrated with the traditional industries.The bikesharing is the integration of the sharing economy with the traditional bike rental.Because of the convenience which traditional bike rental isn't involved,bikesharing has been developing in full swing.At the same time,savage growth and disorderly competition due to the lack of regulation have continued.restricted the development of the bikesharing industry,and imperfect corporate market access mechanisms,imperfect deposit supervision systems,overlapping responsibilities of regulatory agencies,and weak collaborative management capabilities,to a large extent,they are all restricts to the development of bikesharing and the development of sharing economy.Bikesharing is the product of the development of market economy.The volatility of corporate competition tends to lead to market failure.Government supervision is an important effective means of regulating market failure.This article takes the legal relationship existing in the bikesharing industry as the logical starting point,Through the analysis of the status of industry development,it analyzes the problems that still exist in the current regulatory mode of operating bikesharing from the perspective of law,and puts forward specific suggestions for the supervision of shortcomings.This article is divided into five chapters.The first chapter mainly starts from the research background and significance of this article,introduces the development status of bikesharing and sharing platform under the background of Internet,and combs the discussion on legal issues concerning bikesharing of experts and scholars of domestic and foreign.From the perspective of reality,the influence and challenges brought by the development of shared bicycles are analyzed in order to play a guiding role in the writing of this article.The second chapter mainly elaborates the basic theory of bikesharing,defines bikesharing,sharing economy and such related concepts,and focuses on the rise and development of bikesharing,the legal relationship existing in the bikesharing industry,and the necessity of bikesharing regulations.It explored the mainstream opinions of the academic community on the legal relationships involved in bikesharing,and explained the necessity of operating bikesharing supervision in light of the current state of urban infrastructure,environmental pressure,market failure,and consumer protection.lay a logical foundation for the issue of operating bikesharing supervision.The third chapter mainly starts with the regulatory mode of the operating bikesharing industry,analyzes the advantages and disadvantages of the three regulatory models,national supervision,self-regulation and coordinated supervision,and combing with the “Guidance Opinions on Encouraging and Regulating Internet Leasing Bicycles” promulgated by the Ministry of Communications and various regions.The guidance provided an analysis of the regulatory status of the bikesharing industry in different regions.The differences in regulatory policies among different localities are significantly different in the degree of regulation.Some urban regulation concepts are lagging behind.Guidance issued by various localities is still passive and lacks of active guidance.Under the current regulatory model,the industry is still faced with the problem of development.Local regulatory measures “copy and copy” the regulatory principles at the central level.They have not formulated new methods for emerging industries according to their own actual conditions,and the rules “equivalent to no regulations”.The fourth chapter puts forward optimization proposals for the supervision of operating bikesharing,including improving the market access standards for the bikesharing industry,standardizing corporate security for user information,establishing specialized regulatory agencies,and formulating industry norms,improve consumer public interest litigation system etc.,to form a set of systematized.The regulatory system provides institutional support for the sustainable development of the shared bicycle industry.In the context of the Internet era,it is necessary to comprehensively examine the issues related to bikesharing,subvert the traditional regulatory models,remove the drawbacks and play to their strengths,promote the healthy and orderly development of bikesharing.
