Research On The Legal Issues Of China's New Energy Market Access System

Currently,there are a lot of countries to develop new energy sources in response to the current global warming.It's very important to develop and use of new energy sources."Thirteen Five" plan as the transformation of economic development mode,and the debt crisis,the global climate is becoming increasingly serious problems.In that background to develop new energy can be transformed China's economic development,improve the proportion of energy production and consumption,reduce carbon dioxide emissions,thereby improving the climate warming.New energy compared to traditional energy is concerned,with little pollution,large reserves,wide distribution characteristics.Both in terms of theory and practice,whether it is for environmental protection or security and alternative energy considerations,it should be to encourage the development and utilization.But a lot of new energy development will also affect the environment to some extent,thus affecting the energy and economic security.New Energy market access system is a system of government measures to monitor the market,but also a measure of the government to restrict some market players through qualifications and standard.Therefore,based on the special nature of the new energy,set new energy market access system should be encouraged and restrictions.On the one hand to encourage the development of new energy in the market access system design should be fair towards the new energy market players,so domestic capital and foreign capital,private capital and state-owned capital should be treated fairly.On the other hand,energy security should grasp the bigger picture,improving the regulatory authority is very important.We can not relax access conditions in important areas,particularly for environmental impact considerations under the new energy,the EIA approval still needs to be strictly enforced.The new energy market access system currently has many problems,I try to analyze these issues from a legal perspective and propose appropriate measures recommended.This paper focuses on the new energy market access system of legal issues,from the start on the following four aspects: The first part discusses the meaning of the new energy market access system,including the definition of the scope of new energy,new energy market access the connotation of the system,and expound on the necessity of research of new energy access.The second part of the thesis is the main principal of the new laws and regulations in the field of energy to sort out,including the existing laws,department regulations,local laws and regulations and relevant policy documents.On the part of the main legal provisions cited,as discussed below market access issues of new energy laws and the existence of regulatory bodies to pave the way.The third paper,the fourth part is the focus of this paper.The third part discusses the many problems in the new energy market access system currently exists,including the legal system is not perfect,regulatory authorities are confused,the licensing system is not perfecta and the lack of consideration of energy security and other issues.About the legal system and access to the regulatory body is from overall consideration.The system of the approval license is from the local considerations.therefore a separate chapter focuses on the system of the approval license because it is very important.Either in whole or in part,in the design of the system are always grasp the purpose of this important energy security,energy security considerations and therefore also the thesis a part of.The fourth part of the thesis discusses improving market access proposals for new energy systems,the development and utilization of the current market situation starting from the analysis of the new energy,learn the experience from the United States and other developed countries,and then I make the suggestions to improve the new energy access system which are meets to China's national conditions.
