Research On The Internet Fund-raising Fraud Crime

Internet fund-raising fraud crime is a crime committed by the criminal actor for illegal possession,and the crime of illegal fund-raising using the method of fraud,which relies on Internet technology or platform.The main difference between it and the traditional fund-raising fraud crime is that it has outstanding characteristics in the amount of money,the updating of criminal means and the number of people involved,etc.The crime shows the characteristics of intelligence,diversification of the main body,high technology of tools,virtualization of means and serious consequences.The Internet capital fraud crime has more to do with the disruption of the social and economic order than the traditional fund-raising scam,and as the new frontier of our financial industry,the Internet is a huge negative impact on the health and innovation of the Internet finance industry.However,the provisions of traditional fund-raising frauds are applicable to the Internet fund-raising frauds with new criminal means and new criminal characteristics.They are mainly reflected in the uncertainty of the amount of calculation,insufficient protection of investors' interests,and the lack of compulsory disclosure obligation,etc.,which can not be well implemented in the regulation of Internet financing fraud,and the protection of Internet financial development and the interests of investors.Therefore,in view of the existing problems of Internet financial regulation in China highlighted by the Internet financing fraud cases,it is the key to promote the innovation and development of Internet finance in China by exploring and perfecting ways and measures.This article will analyze the current status and crime of the Internet capital fraud crime,and then suggest a countermeasure with foreign regulations.The first part of this paper mainly introduces the basic connotation of the crime of Internet fund-raising fraud,the types and characteristics of Internet fund-raising frauds at present,and analyzes the constitutive elements of the judicial identification of Internet fund-raising fraud,and introduces the judicial determination of Internet financing fraud.In the second part of this article,on the basis of the necessary introduction of our country's regulation of the Internet capital fraud crime,we analyze the current situation and the existing problems of the current law enforcement of the Internet collection of Internet funds,and point out that there are two problems in the legislation and judicial decision of the Chinese Internet fund fraud system.This article third part to the Internet in China financial fraud crime legislation perfect countermeasures are proposed.The above are the main contents of this paper.
