Since the new century,the speed of the development of computer and Internet has been speeding up.In the process of the new generation of technology,e-commerce came into being and infiltrated into people's daily life in a short period of time.In the current rapid development of third-party payment platform represented by Alipay,there is a lack of a complete legal system to regulate all aspects of third-party payment platform.To manage third-party payment platforms,one or two laws alone are not enough.Therefore,the legal rules of the third-party payment platform must be carried out from the overall situation,and all relevant departments should be adopted in a comprehensive manner.The regulation measures of door law.This paper is divided into five parts.The first part is the introduction,mainly introduces the background and significance of this study,and discusses the current research situation at home and abroad,and puts forward the main research methods and basic research ideas used in the research process.This paper introduces the research content and innovation.The second part defines the concept of "third-party payment platform" and "third-party payment",and discusses the legal environment of third-party payment platform from the legal connotation.To define "third party payment" from the angle of legal attribute and legal relation,and to clarify the third party payment and third party payment.The position of platform in Chinese law.The third part is the focus of this paper,introduces the current legal development of third-party payment platform in China,and points out the deficiencies.The fourth part mainly studies our country to the third party payment platform in the legal level improvement strategy measure.On the basis of the laws and regulations of the European Union,the United States and Asian countries on the third-party payment platform,this paper puts forward that our country's law should deal with the situation of the third party payment platform.Third-party payment platform should have the basic rules,and put forward related improvement suggestions.These measures include promoting platform access and withdrawal,improving the management of depositing funds,strengthening information protection for customers,strengthening anti-money-laundering efforts,and clarifying the legal responsibilities of all parties.The fifth part is a summary,a clear concept of the full-text research,and put forward the future research trend of this study.It is pointed out in this paper that there are some shortcomings in legislation and implementation in many aspects in our country,regulatory lag easily to users a direct economic loss,even threaten the financial security of our country.This paper holds that gradually formed a compelet legal supervision system,to promote the prosperity and progress of China's overall economic market.This paper analyzes the legislation and practice of the extraterritorial third-party payment platform,Combined with our reality,take Alipay WeChat and other new third-party payment platforms as an example,Constructively proposed specific solutions,in order to promote the sustainable healthy development of third party payment platform,create a more secure,efficient and convenient payment market environment.
