Spatiotemporal Analysis And Countermeasures Of Land Petition In Changle District,Fujian Province

At present,our country is in the period of strategic opportunity of economic and social development and the period of social contradictions,these two important periods,such as unbalanced,uncoordinated and unsustainable problems are difficult to solve in social development.On the one hand,the state has continuously strengthened its control over land,resulting in the continuous tightening of land supply;On the other hand,the rapid development of the social economy itself has made the demand for land more urgent.As a result,the contradiction between land supply and demand has become increasingly prominent.Therefore,more and more land conflicts are constantly expressed through the channels of land petition.In this study,940 letters and letters from Changle District from 2013 to 2015 were selected as the research objects.Through the analysis of time,space,and time,the main conclusions are as follows:(1)According to the analysis of the time,a total of 948 letters and visits to the land in Changle District were obtained,and the overall trend was declining.The content of land letters and visits was relatively prominent in terms of illegal land use and land acquisition,accounting for 49%and 41%of the total number of land letters and visits,respectively.At present,the complainants mainly complain to the higher authorities.However,with the development of science and technology,online complaints will become the mainstream of complaints.Individual complaints account for the majority,and collective petitions have increased year by year.(2)According to spatial analysis,the occurrence of land petition cases in Changle District shows regional characteristics.The townships with a large amount of land petition are concentrated in the peri-urban areas and relatively developed areas,and the townships and streets with good economic development levels.The more concentrated the content of petition visits,Although the overall number of land petition cases has decreased in the past three years,the number of land petition cases in the two main types of townships and streets with good economic development has decreased only slightly.The reason may be caused by the contradiction between the land used for economic development construction and the cultivated land of farmers.Individual visits are the main forms of townships,but the issue of land acquisition and the high level of economic development in the township group visits and collective visits in the townships also account for a high proportion.(3)The cross-examination of time and space shows that the number of cases of land petitions in townships and towns decreased significantly during the three years from 2013 to 2015.Most of the township land petition in Changle District has a serious problem of good economic development,and the content of the land petition is concentrated.The problem of illegal land use and land acquisition is particularly prominent.The proportion of collective petitions has become larger.On the one hand,due to the large number of enterprises caused by economic development,and the construction land area required for the development of enterprises and factories is relatively large,resulting in an increase in conflicts with collective farmers;On the other hand,Changle District is located in Haiduo Mountain,causing the per capita possession of arable land to be very small,and it is also easy to cause collective land petitions.(4)This study analyses the number,content,mode,number of people and tax indicators of land petitions by means of time,space,and space-time cross-analysis.The reasons for the existence of land petition in Changle District are social reasons,including the contradiction between developing the economy and protecting the land.The compensation and resettlement system for land acquisition is unreasonable and the implementation is not standardized.The reasons of law and policy mainly include the lack of widespread promotion of land policies and land laws and regulations,and the lack of professional legal guidance and norms in the petition work.The historical reasons from the land use certificate during the land reform period and the occupation of land in the planned economy indicate the historical legacy of the land petition in Changle District.The reason of the complainant mainly explained that the complainant's awareness of rights protection has improved,but the poor quality of the complainant has led to repeated petitions by the complainant and the number of letters and visits has increased.(5)Based on the proper handling of the land petition,this paper proposes to start with the following aspects:in combination with the original conflict of laws to establish a perfect and effective legal mechanism;We will improve the system of compensation and resettlement schemes for land acquisition;In combination with the publicity and promotion of legal petitions and legal visits.
