Research On The Liability Of Compensation For Damages About Autonomous Vehicles

Nowadays Internet Technology and Artificial Intelligence Technology is developing rapidly.In the field of automobile production,autonomous vehicles based on Internet technology and artificial intelligence has become a hotspot all over the world,the popularity of autopilot vehicles seems to come true when conditions are ripe.But most of the autonomous systems on the market are still in the low-level stage called driving assistant,they still have many potential safety hazards.Worldwide,accidents caused by autopilot cars happen frequently.On a global scale,traffic accidents caused by autopilot cars occur frequently,caused some property damage and casualties,has aroused widespread concern of the whole society.Therefore,the problem of imputation principle and liability about the traffic accidents caused by autonomous vehicle is urgent to be solved.A perfect imputation system is a prerequisite for healthy development of autonomous vehicles industry.And how to define the subject of liability is the key for the system.So we discuss how to claim for damages in a accident about automobile used some cases happened these years,and advance a theory about that based on Chinese national conditions and policies.In part one we discuss about what is autonomous car and what is the typical characteristics of liability of compensation for damages about autonomous vehicles,and pose the core issue of the article.In part two,we discuss the difference of subject in accident between autonomous and traditional cars,and explain it with some cases from home and abroad.In part three,fault liability and no-fault liability is the two principle suit for judging the liability in traffic accidents.The fourth part combines the relevant laws and regulations of China,draws on the relevant regulations of the United Kingdom and Germany,and puts forward opinions on the scope,basis and system of damage compensation for autonomous vehicles.The fifth part analyzes the reasonable exemption situation applicable to the responsible subject to ensure that the legitimate rights and interests of the responsible subject are guaranteed.The paper are aimed at solving the question that how to blame the liability,who will bear the burden,how to undertake,and what is the basis of responsibility.Examples of accidents that occurred during the course,from the difference between the autopilot and the ordinary car in the responsible subject,and then the application of the fault and the principle of faultless imputation of different responsible subjects,to consider the autonomous driving car with general applicability.The accident liability theory system describes the special requirements for laws and regulations from autonomous driving under the current legal system,and also discusses the exemption situation outside the principle of imputation.Since there are still relatively difference about regulations and policies on autonomous vehicles between China’s laws from those of developed countries in the West,we also combined with the relevant laws and regulations of Western countries to build a legal system for autonomous vehicles in line with China’s actual conditions.
