Research On The Determination Of Criminal Responsibility For Traffic Accidents Caused By Autonomous Vehicles

Autonomous driving technology and artificial intelligence are regarded as the fourth industrial revolution after the age of steam engine,electric age and information age.In recent years,with the rapid development of artificial intelligence,autonomous driving technology has made great progress.While people enjoy the convenience brought by autonomous driving technology,a series of legal problems related to autonomous driving vehicles also appear.One of the most serious is the self-driving car traffic accident.As for the identification of the criminal responsibility for traffic accidents caused by autonomous driving vehicles,opinions vary in the academic circle,and the relevant legislation also shows a certain lag,which makes it difficult to identify the relevant subjects in the judicial practice.This paper mainly focuses on particularity of self-driving car traffic offense behavior as well as to the analysis of a challenge in the current criminal law,in the theoretical circle in two views on the controversial issue of carding,namely self-driving cars and automatic driving a car crime main body status of the problems related to the behavior main body problem of criminal responsibility identification,finally put forward the self-driving car traffic accident identified in stages of criminal responsibility.The article is mainly divided into five parts:The first part is the introduction,which mainly elaborates the research significance of this paper,the research status of autonomous driving vehicles at home and abroad,as well as the identification status of the criminal responsibility for traffic accidents caused by autonomous driving vehicles abroad,and finally summarizes the research methods and innovations of this paper.The second part mainly through the study of the interpretation of the basic theory of automatic driving a car,let people understand self-driving cars,and through the introduction of the meaning of self-driving car traffic accident and the behavior of self-driving car traffic accident types,analysis of self-driving automobile traffic accident and the difference between traditional automobile traffic accident.The third part mainly starts from the criminal law system,and analyzes the impact of the traffic accident caused by the autonomous driving vehicle on the current criminal law,as well as the challenges brought by the determination of the criminal responsibility of the traffic accident caused by the autonomous driving vehicle to the specific charges.The fourth part then sorts out the theoretical viewpoints on the identification of criminal responsibility for traffic accidents caused by autonomous driving vehicles,and then comments on the viewpoints put forward by scholars,laying a theoretical foundation for the assumption of the identification of criminal responsibility for traffic accidents caused by autonomous driving vehicles in stages as follows.The fifth part from the patterns of distribution of self-driving cars criminal responsibility,the obligation of results to avoid violation and the rebuild of causality,argument self-driving car traffic accident that the rationality of criminal liability assumed by stages,and finally from the self-driving car production,manufacture and sales of phase and use phase,the specific discussion self-driving car traffic accident that criminal responsibility should be how to do it.
