On The Normative Construction Of Freedom Of Career

Freedom of choice as a fundamental right to protect the citizens' earning a living,the state either clarifies it on the constitutional text or through constitutional lawsuits and other means to achieve substantive constitutionalism.However,China has not clearly defined it as the basic right of the constitution.The academic community has not paid much attention to the study of freedom of choice.The lack of protection at the constitutional level makes it impossible for Chinese citizens to achieve true freedom when choosing a profession.The enumerated constitutional rights are still in a state of stagnation in our country.This paper intends to make a slight remedy for the lack of research on the theory of freedom of choice,starting from the attributes of basic rights and exploring the normative structure of freedom of choice.As a basic right,freedom of choice is closely related to the dignity and property rights of citizens.It is the specific form of the development of personal dignity.At the same time,the free exercise of the right to choose is often one of the important sources of wealth accumulation,and the property rights protect citizens.The accumulated wealth created by the right to freedom of choice.Freedom of choice is an important part of the three major freedoms of modern society.It is closely related to human rights protection.It contains important objective law order and function and has important constitutional status.While paying attention to theoretical analysis,the author is based on the practice of our country—comparing the status quo and judicial application of freedom of choice,analyzing the true state of our country's career choices,and pointing out the necessity of incorporating the right to freedom of employment into the constitutional protection level.He tries to explain the liberty rights of labor rights,and hopes to provide the Chinese-style path for the protection of the constitutional freedom of employment by clarifying the relationship between freedom of choice and labor rights and incorporating freedom of employment into the protection of labor rights.
