Parsing The Energy Charter Treaty In The Field Of Energy Cooperation

The Energy Charter Treaty is a meaningful multilateral agreements strengthening the international society cooperation in energy field. In the new impetus of global economy development, countries will start the new energy diplomacy, which means a new round of energy contest、energy dialogue and energy cooperation will develop rapidly. Meantime, it also brings economic instability factors caused by the communication and consultation among developed countries、among developed countries and developing countries and among developing countries. These instability factors include various differences in all sorts of investment way、trade rules、dispute settlement mechanism and environmental protection. The Energy Charter Treatyis the world’s only one multilateral agreement thing that can contain both the main energy host country and the energy investor country.It has certain legal meaning. From the point of view of the sustainable development, this paper gives the explanation on the partial main clause and theme spirit of the Energy Charter Treaty. Thirdly, in the third part, I quote some terms about the energy transport and the environmental protection which notes in the Energy Charter Treaty, analyzingthe legal nature of environmental protection based on the aims and objectives of the treaty, meantime,sure of the treaty outstanding contributions for the transit transport. Finally, I will give a reasonable interpretation of the Energy Charter Treaty in the dispute settlement mechanisms and other terms of the specification need to focus on the process of energy trading activities. And use the actual existence of the phenomenon and case studies to illustrate the specification and applicability of the treaty. In summary, the Energy Charter Treaty is still having an irreplaceable binding legal effectin the new era of energy dialogue and energy cooperation.
