Research On Auto Driving Accident Liability System

With the rapid development of artificial intelligence technology,self-driving cars as a new thing appear in the public line of sight.At present,the development of autonomous driving technology is faster and faster,and its safety has reached a higher level.Still,there is no guarantee that there won't be any traffic accidents.The problems related to traditional motor vehicle traffic accidents can be basically solved by existing laws.However,due to the particularity of self-driving cars,some problems caused by them cannot be fully applied to existing laws.When there is a serious traffic accident,the judicial organ lacks the legal basis for the judgment when it faces the blank of relevant laws.This not only fails to effectively protect the legitimate rights and interests of the infringed,but also makes the public suspicious of autonomous driving,thus hindering the development of autonomous vehicle technology.From the perspective of traffic accident liability of self-driving cars,the author selects typical cases and analyzes corresponding legal problems,analyzes and compares domestic and foreign legislation,and puts forward some targeted legislative Suggestions on the problems found.This paper is divided into four chapters to demonstrate the relevant issues:Firstly,starting from the first case of death caused by autonomous driving in China,this paper analyzes the trial of the case and puts forward specific problems,that is,the product liability system is not enough to regulate the liability for traffic accidents of autonomous vehicles,and the liability identification is facing difficulties.Second,analyze the current domestic policies and regulations on self-driving cars in China,and compare the views of different scholars on the legislation of self-driving cars.It mainly explores the legislative issues related to self-driving cars and puts forward its own opinions based on the viewpoints and opinions of relevant scholars.Third,countries outside the region to learn from the legislation.This paper summarizes the inspiration of other countries' excellent legislation from the relevant legislation of western countries,and finds out the legislative experience suitable for China's national conditions.Fourthly,it summarizes the legislative countermeasures of China's self-driving car traffic accidents from the two aspects of product liability system and road traffic safety system.
