Research On The Legislation Protection Of Personal Information Right Under The Network Environment In China

With the rapid development of network technology,China's Internet penetration rate marks that China has entered the Internet era.What follows is that various problems emerge in an endless stream,among which the problems represented by citizens' personal information need to be solved urgently.For example,the disclosure of personal information and illegal trading resulting in the infringement of rights and interests and so on.If the network security cannot be guaranteed,it will directly affect the development prospect of China's Internet industry.In order to promote the legislation of personal information protection law in China,this paper sorted out and analyzed a large number of literature materials,summarized the current Internet domain of citizens' personal information right infringement behavior and characteristics,as well as various challenges faced by personal information.China has issued laws on the network environment of citizen personal information protection has played a positive role,but there are still a variety of deficiencies.For example,in the laws related to the protection of personal information has not yet formed a unified protection rules lack of corresponding tort relief measures and channel government supervision is weak has not yet formed the industry self-discipline and other problems.This paper discusses the protection of personal information rights in China's Internet through five chapters:First,chapter clarifies the background and significance of personal information protection,summarizes the degree of research on the protection of personal information rights at home and abroad,so as to explore new analytical perspectives;Second chapter enumerates the characteristics of the infringement of personal information right in China's Internet field,clarifies the subject and object of the infringement,and then analyzes the harm caused by the infringement of personal information right to individual society and country;and again,the author summarizes the enlightenment of overseas excellent legislation to our country,and puts forward the advantages and disadvantages of legislation protection of personal information right for our country to use for reference and consideration;and again,deeply analyzes the loopholes and deficiencies in the current legal protection of personal information rights in the Internet field;Last,after comparing the legislation of individual information security in Europe,America and Japan,the author puts forward the corresponding improvement measures according to the deficiencies of personal information protection in China's current laws and China'sspecific national conditions,so as to form a complete legal protection system and jointly protect citizens' personal information rights and interests.
