Study On The Disciplinary System Of Judges

With the gradual acceleration of China's overall promotion of the rule of law,the speed of judicial system reform is also becoming faster and faster,which sets a higher standard for the impartiality of judges.The judge punishment system can punish the judge's violation of law and discipline in a timely and effective manner,and its effective construction can undoubtedly provide an effective guarantee for judicial integrity and judicial justice.Due to the unsound punishment system for judges in China at the present stage,it is not possible to provide a systematic and perfect system supply.Therefore,it is necessary to construct the punishment system for judges in China in a systematic way.Based on this,the comprehensive,on the basis of predecessors' research results,and draw lessons from the advanced countries under the rule of law,such as Britain and the United States,Germany,the beneficial experience of judge disciplinary system,combining the judge disciplinary system in our country present situation and the existing problems,put forward to reconstruct the reasons of our country judge disciplinary system,procedures,methods and relevant Suggestions,in order to further perfect judicial system.The first chapter expounds the necessity and feasibility of judge punishment system,and analyzes its theoretical basis,which lays a foundation for the following discussion.The second chapter compares the punishment systems of judges in three foreign countries: the United Kingdom,the United States and Germany,and summarizes the significance and inspiration of the above systems to the punishment system of judges in China.The third chapter studies the current implementation of the judge punishment system in China from two aspects of text and practice,and takes typical cases as the object of investigation and analysis to analyze the prominent problems in the implementation process of the systemThe fourth chapter,combined with the problems elaborated in the third chapter,points out how to reconstruct the punishment system of judges in China from the macro and micro perspectives.The macro level focuses on the following points the basic principles to be followed in the reconstruction of the punishment system of judges,and the micro level conceieves the specific system design.
